Dle jejich slov m\u011bl \u00fasek investic postupovat formou ohl\u00e1\u0161en\u00ed stavby, \u010d\u00edm\u017e by odpadla \u010dasov\u011b n\u00e1ro\u010dn\u00e1 nutnost z\u00edsk\u00e1vat p\u00edsemn\u00e9 souhlasy od v\u0161ech majitel\u016f dom\u016f a pozemk\u016f v lokalit\u011b. Argumentem pro tato tvrzen\u00ed byl obdobn\u00fd postup p\u0159i rekonstrukci n\u00e1m\u011bst\u00ed v\u00a0Kutn\u00e9 Ho\u0159e.<!--more--><\/p>\n<p style=\"text-align: justify;\">Jako\u017eto n\u00e1m\u011bstek zodpov\u011bdn\u00fd za m\u011bstsk\u00e9 investice s\u00a0t\u00edmto tvrzen\u00edm nemohu souhlasit. Postup stavebn\u00edho \u00fa\u0159adu je z\u00e1vazn\u011b stanoven z\u00e1konem (stavebn\u00ed z\u00e1kon a spr\u00e1vn\u00ed \u0159\u00e1d) a mus\u00ed b\u00fdt respektov\u00e1n. V\u00a0p\u0159\u00edpad\u011b poru\u0161en\u00ed t\u011bchto p\u0159edepsan\u00fdch postup\u016f by do\u0161lo k\u00a0nez\u00e1konnosti \u00fazemn\u00edho rozhodnut\u00ed a z\u00a0toho vypl\u00fdvaj\u00edc\u00edch pr\u00e1vn\u00edch n\u00e1sledk\u016f.<\/p>\n<p style=\"text-align: justify;\">Sou\u010d\u00e1st\u00ed pl\u00e1novan\u00e9 rekonstrukce Velk\u00e9ho n\u00e1m\u011bst\u00ed jsou stavebn\u00ed \u00fapravy st\u00e1vaj\u00edc\u00edch staveb i\u00a0um\u00edst\u011bn\u00ed nov\u00fdch staveb, kter\u00e9 vy\u017eaduj\u00ed vyd\u00e1n\u00ed \u00fazemn\u00edho rozhodnut\u00ed. Jedn\u00e1 se zejm\u00e9na o\u00a0vodovodn\u00ed a dal\u0161\u00ed p\u0159\u00edpojky do jednotliv\u00fdch dom\u016f.<\/p>\n<p style=\"text-align: justify;\">Dle \u00a7 76 sou\u010dasn\u00e9ho zn\u011bn\u00ed stavebn\u00edho z\u00e1kona lze umis\u0165ovat stavby jen na z\u00e1klad\u011b \u00fazemn\u00edho rozhodnut\u00ed nebo \u00fazemn\u00edho souhlasu. Mezi n\u00e1le\u017eitosti \u00fazemn\u00edho rozhodnut\u00ed pat\u0159\u00ed i podm\u00ednka, \u017ee jestli\u017ee \u017eadatel, v\u00a0tomto p\u0159\u00edpad\u011b m\u011bsto, \u201e&#8230; n<em>em\u00e1 vlastnick\u00e9 pr\u00e1vo, smlouvu nebo doklad o pr\u00e1vu prov\u00e9st stavbu nebo opat\u0159en\u00ed k\u00a0pozemku nebo stavb\u011b, <strong>p\u0159edlo\u017e\u00ed souhlas jejich vlastn\u00edka<\/strong> &#8230;\u201c.<\/em> V\u00a0tomto p\u0159\u00edpad\u011b tedy nelze prov\u00e9st postup, kdy by spr\u00e1vn\u00ed org\u00e1n pouze obeslal vlastn\u00edky dot\u010den\u00fdch pozemk\u016f nebo staveb s\u00a0t\u00edm, \u017ee pokud se do ur\u010dit\u00e9 lh\u016fty nevyj\u00e1d\u0159\u00ed, se z\u00e1m\u011brem a s\u00a0dot\u010den\u00edm sv\u00fdch nemovitost\u00ed souhlas\u00ed.<\/p>\n<p style=\"text-align: justify;\">Zm\u00edn\u011bn\u00e1 rekonstrukce v\u00a0Kutn\u00e9 Ho\u0159e prob\u011bhla p\u0159ed novelou stavebn\u00edho z\u00e1kona, kter\u00e1 zm\u011bnila jak rozsah staveb, kter\u00fd podl\u00e9h\u00e1 um\u00edst\u011bn\u00ed a n\u00e1sledn\u00e9mu povolen\u00ed stavebn\u00edho \u00fa\u0159adu, tak z podstatn\u00e9 \u010d\u00e1sti i zp\u016fsob doru\u010dov\u00e1n\u00ed v \u00fazemn\u00edm \u0159\u00edzen\u00ed.<\/p>\n<p style=\"text-align: justify;\">Dosavadn\u00ed postup je pro navr\u017een\u00fd rozsah stavby jedin\u00fd mo\u017en\u00fd a v\u00a0souladu se z\u00e1konem, na co\u017e m\u00e1 magistr\u00e1t i stanovisko JUDr. Mare\u010dka, jednoho ze spoluautor\u016f stavebn\u00edho z\u00e1kona.<\/p>\n<p style=\"text-align: justify;\">Z\u00e1v\u011brem mi dovolte \u0159\u00edci, \u017ee rekonstrukce Velk\u00e9ho n\u00e1m\u011bst\u00ed je hlavn\u00ed prioritou nejen odbor\u016f v\u00a0m\u00e9 gesci, ale cel\u00e9ho veden\u00ed m\u011bsta.
